SPECIAL, INDIRECT,PUNITIVE OR CONSEQUENTIALDAMAGES WHATSOEVER,INCLUDING,
WITHOUT LIMITATION,DAMAGES FOR LOSSOF PROFITS,LOSS OF DATA,BUSINESS
INTERRUPTION, ORANY OTHER COMMERNCIALDAMAGES ORLOSSES, ARISING OUTOF OR
RELATED TOYOUR USE ORINABILITY TOUSE THE SOFTWARE,HOWEVER CAUSED,
REGARDLESS OFTHE THEORYO F LIABILITY (CONTRACT,TORT, OROTHERWISE) AND EVEN
IF TOSHIBAAND/OR ITS SUPPLIERSHAS BEENADVISED OFTHE POSSIBILITY OFSUCH
DAMAGES. SOMEJURISDICTIONS DO NOTALLOW THELIMITATION OF LIABILITYFOR
PERSONAL INJURY,OR FOR INCIDENTALOR CONSEQUENTIALDAMAGES; THEREFORE, THE
ABOVE LIMITATIONSMAY NOT APPLYTO YOU UNDERSUCH CIRCUMSTANCES. THE
AGGREGATE LIABILITYOF TOSHIBA ANDITS SUPPLIERSIN CONNECTION WITHTHE
SOFTWARE, REGARDLESSOFTHE FORMOF ANYLEGAL ACTIONOR PROCEEDING,SHALLBE
LIMITED TODIRECT DAMAGESNOT TO EXCEEDTHE AMOUNTPAID FOR THETOSHIBA BLU-
RAY PLAYER.
Article 6Export Control
Any export, directlyorindirectly, ofthe Softwarein contraventionof theUnited StatesExport Administration
Regulations, orany other applicablelaw, regulation,or order, is prohibited.
Article 7Termination of License
In theevent that youfail tocomply with anyof theterms and conditionscontained herein,Toshiba shall have
the rightto immediately terminatethis Agreementwithout any notificationto you.Upon termination ofthis
Agreement, youshall cease alluse ofthe Software anddestroy allcopies, in wholeand/or inpart.
Article 8Governing Law
This EULAisgoverned bythe lawsof Japan,withoutreferences tothe conflictof lawsprinciples.Any andall
disputes arisinghereunder shall beresolved exclusivelyby the TokyoDistrict Court,Japan, and youhereby
consent tothe exclusive jurisdictionof suchcourt.
Article 9Severability
If anyprovision of thisEULA shallbe held tobe invalid,illegal or unenforceable,the validity,legality and
enforceability ofthe remaining provisionshereof shallnot in anyway beaffected or impaired.
