B. It is your responsibility to i mpose any restrictions on viewing by you, other
members of your household, or guests, and we shall have no liability to anyone due to or
based on the content of any of the Services furnished to you.
8. WARNING AGAINST PIRACY
It is a violation of several U.S. federal and state laws to receive any Services, or any
portion of such Services, without paying for them. The penalties for violating such laws
can range from imprisonment to civil damage awards of up to $110,000 per violation.
9. MISCELLANEOUS
A. Physical Address/Change of Address. When setting up your DISH Network
account, y ou agree to provide us w ith the ph ysical street address where the Equipment
will be located. A post office box does not constitute a physical address and is not
sufficient to meet this requirement. You agree to give us prompt notice of your change of
nam e, mailing ad dress, physic al address where the Equipment is loca ted or tele pho ne
number. You may do this by no tifying our Customer Service C enter b y telephone or in
writing.
B. N otice
. If we send you notice, it will be considered given when deposited in
t he U .S. Mail, addresse d to you at your billing a ddress or ha nd -deliver ed to yo u. Our
notice to you will also be effective if provided on your billing statement or by telephone.
If you give notice to us, it will be deemed given when received by us at the address listed
on the first page of this Agreement.
C. Applicable Law
. This Agreement, including all matters relating to its validity,
construction, performance and enforcement, shall be governed by applicable federal law,
the rules and regulations of the Federal Communications Commission, and the laws and
regulations of the state and local area where Service is provided. These terms and
con ditio ns are s ub ject to ame ndm e nt, modific atio n or termin atio n if require d by such
regul ati ons o r laws. If a ny provision in th is Agre em e nt is decla red to b e illegal or in
conflict with any law or regulation, that provision may be deleted or modified, without
affecting the validity of the other provisions.
D. Other
. This document contains the entire agreement between DISH Network
and you, the custome r, and no sa lesp erson , installer, cu sto m er service repres entati ve,
authorized retailer, or other sim ilarly situated individual is authorized to change the terms
set forth herein. DISH Network m ay, however, change the terms and conditions of this
Agreement in the future and will notify you if that occurs. The terms of this Agreement,
which either areexpressly stated to survive or by their nature would logically be expected
to survive termination, shall continue thereafter until fully performed.
Staying Legal
Title 47, Section 605(e)4, United States Code (U.S.C .) makes it a federal
crime to modify this receiver to enable it to receive encrypted (scrambled)
television programming without payment of required subscriptions.
Conviction can re sult in a fine of up to $500,000 and imprisonment for five
years, or both. Any owner of this receiver who procures or willfully causes
its modification is an accessory to that offense and may be punishable in the
same manner. Inve stigative authority for violations lies with the Federal
Bureau of Investigation (FBI).
This product may incorporate copyright protection technology that is
protected by U.S. patents and other intellectual property rights. Use of such
copyright protec tion technology m ust be authoriz ed by Macrovision, and is
intended for home and other limited pay-per-view uses only unless
otherwise authorized by Macrovision. Reverse engineering or disass embly
is prohibited.
